FilExpire is a secure, temporary file sharing service designed for legitimate use between friends, family members, colleagues, and other consenting parties who need to share files securely.

This service is intended for:

• Sharing documents between team members
• Sending files to friends and family
• Temporary storage of legitimate files
• Secure file transfer for business purposes
• Educational and research purposes
• Any legal file sharing where security and privacy matter

Where We Operate

FilExpire is hosted in France within the European Union and operates under French and EU law. This means your files are protected by some of the world's strongest privacy regulations.

Laws That Apply

By using FilExpire, you agree to comply with:

• French national laws and regulations
• European Union directives and regulations (including GDPR)
• International copyright and intellectual property laws
• Your local jurisdiction's laws regarding file sharing
• Any applicable international treaties and agreements

Your Privacy Rights Under GDPR

As a service hosted in the EU, we must comply with the General Data Protection Regulation (GDPR), which gives you strong rights:

• Right to transparency - We clearly explain what data we collect
• Right to access - You can request information about your data
• Right to rectification - Correct any inaccurate data
• Right to erasure - Automatically enforced through file expiration
• Right to data portability - Download your files anytime before expiration
• Right to object - Stop using the service at any time

Law Enforcement Cooperation

While we cannot access your encrypted files due to our zero-knowledge architecture, we will cooperate with French and EU law enforcement when legally required, including:

• Providing non-content metadata when compelled by valid court orders
• Responding to properly executed legal requests from EU authorities
• Reporting suspected illegal activity as required by French law
• Complying with European Arrest Warrants and mutual legal assistance

Important: Due to our encryption system, we cannot provide access to file contents even if legally compelled to do so, because we don't have the decryption keys.

What We Provide

FilExpire offers secure temporary file sharing with the following limits to prevent abuse:

• File Size: Maximum 200MB per file
• Upload Rate: Reasonable limits to prevent spam and abuse
• Storage Time: Files automatically expire based on your settings
• Download Limits: You can set how many times files can be downloaded
• File Types: Executable files and dangerous formats are blocked for security

Service Availability

This service is provided "as-is" without warranty. While we strive for reliability, we cannot guarantee:

• 100% uptime or constant availability
• Data recovery if technical issues occur
• Specific performance levels or upload/download speeds
• Continuous operation without maintenance periods
• Compatibility with all devices or browsers

Backup Important Files: Always keep backup copies of important files. While our service is reliable, any online service can experience technical issues.

No Warranty

FilExpire is provided "AS IS" and "AS AVAILABLE" without any warranties of any kind, either express or implied.

Liability Limits

To the maximum extent permitted by French and EU law, FilExpire shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, data, use, goodwill, or other intangible losses
• Any damages resulting from your uploaded content or sharing activities
• Any damages caused by third parties accessing your files
• Any consequences of your violation of these terms

You upload and share files entirely at your own risk and responsibility.

By using FilExpire, you take full responsibility for:

• Legal Compliance: Ensuring all uploaded content is legal in all applicable jurisdictions
• Rights & Permissions: Having the legal right to share all uploaded files
• Password Security: Keeping passwords secure and sharing them only with intended recipients
• Appropriate Use: Using the service only for its intended legitimate purposes
• Terms Compliance: Following all terms and applicable laws
• Consequences: Any legal, financial, or other consequences from your use of the service
• GDPR Compliance: Ensuring you have lawful basis for sharing personal data
• Recipient Consent: Ensuring recipients agree to receive the files you share

Indemnification

You agree to indemnify, defend, and hold harmless FilExpire, its operators, and hosting providers from and against any and all claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to:

• Your use or misuse of the service
• Any content you upload, share, or transmit through the service
• Your violation of these terms or any applicable law
• Any third-party claims related to your uploaded content
• Any damages, losses, or harm resulting from your files or sharing activities

Age Requirements

You must be at least 16 years old to use FilExpire, or have explicit parental consent if you're younger and local laws permit.

Data We Collect (GDPR Article 13 Disclosure)

We collect the absolute minimum data necessary for security and functionality:

• IP addresses - For security, abuse prevention, and enforcing access restrictions
• File metadata - Filename (for abuse prevention), size, expiration time, download count (but never file contents)
• Upload/download timestamps - For security monitoring and file management
• Browser information - Only what's needed for security features and compatibility

Data We Never Collect

• Cookies - We use zero cookies, not even for sessions
• Unencrypted file contents - Files are stored encrypted
• Your passwords - Only cryptographic hashes are stored. None is processed if you use the zero-knowledge method.
• Personal information - No names, emails, or profiles required
• Tracking data - No tracking, analytics, or cookies of any kind
• Browsing history - We don't track what you do outside FilExpire

Legal Basis for Data Processing (GDPR Article 6)

• Legitimate Interest: Providing secure file sharing and preventing abuse
• Consent: By using the service, you consent to necessary data processing
• Legal Obligation: Compliance with French and EU law requirements

Data Retention & Deletion

• Files: Automatically deleted when they expire (you choose the time)
• Metadata: Deleted when files expire
• Security logs: Kept for maximum 1 year - as per french laws, then automatically deleted
• No permanent profiles: We don't build lasting profiles about users

What Our Security Protects Against

FilExpire's security measures protect against:

• Unauthorized access to your files
• Data breaches (files remain encrypted even if our servers are compromised)
• Network interception during upload/download
• Casual browsing of stored files
• Mass surveillance of file contents

What We Cannot Protect Against

No security system is perfect. Our system does NOT protect against:

• Password theft or social engineering attacks
• Compromised devices (yours or the recipient's)
• Someone guessing or cracking weak passwords
• Legal compulsion to provide available data or facilitate access
• Advanced persistent threats by nation-state actors
• Physical security breaches of your devices

Your Role in Security

Security is a shared responsibility. You must:

• Use strong, unique passwords or let us generate them for you
• Share download URLs and passwords through different, secure channels
• Keep your devices secure and updated
• Be cautious about who you share files with
• Report any security issues to us promptly

How We Respond to Violations

If we become aware of violations of these terms, we may:

• Immediately delete offending files
• Block IP addresses or implement access restrictions
• Report suspected illegal activity to French authorities
• Cooperate with French and EU law enforcement investigations
• Terminate access to the service for repeat offenders

Reporting Violations or Illegal Content

To report suspected violations or illegal content:

• Contact us through our contact page with specific details
• Provide the file URL if known
• Include relevant legal basis for your report
• Be specific about the nature of the violation

Note: We can investigate available metadata and take appropriate action regarding policy violations.

These terms may be updated periodically to reflect changes in law, technology, or service features. Continued use of the service after changes constitutes acceptance of new terms.

For significant changes affecting your rights, we will provide notice in accordance with GDPR requirements where applicable.
